LISTING WATCHER TERMS AND CONDITIONS
Use of the Listing Watcher service ("Service") by a website user ("User") is governed by the following
Terms and Conditions:
User understands and agrees, as consideration for using the Service, Listing Watcher reserves
in its own discretion to deny User access to the Service for any or no reason whatsoever without
notice and without recourse.
Listing Watcher reserves the right to modify, amend or terminate the Service at any time, including
but not limited to, changing the Terms and Conditions for use of the Service.
User warrants, represents and agrees that it shall not use the Service in connection with any content
that is infringing, libelous, defamatory, obscene, abusive, offensive or otherwise violates any law or
right of any third party.
These Terms and Conditions are void where prohibited by law, and the right to use the Service is
automatically revoked in such jurisdictions.
As a condition to using the Service, User will be required to select a Username and password. User shall
provide Listing Watcher with accurate, complete and updated information. User may not (i) select or use as
a Username a name of another person with the intent to impersonate that person; (ii) use as a Username a
name subject to any rights of a person other than the User without appropriate legal authorization;
(iii) register for the Service using more than one Username. Listing Watcher reserves the right to refuse
registration of, or cancel a Username, at its sole discretion. User shall be responsible for maintaining
the confidentiality of User's Listing Watcher password.
Listing Watcher makes no warranty, express, implied or statutory, with respect to any matter.
In now event shall Listing Watcher be liable for any consequential, indirect, special, incidental,
or punitive damages, including lost business, lost profits, cover, revenue, goodwill, or other related
damages, whether based in contract, warranty, tort or otherwise, even if Listing Watcher has been advised
of the possibility of such damages.
Listing Watcher is in no way associated or affiliated with Prosper Marketplace, Inc. and in no way endorses
or guarantees User's success with the peer-to-peer lending model.
These Terms and Conditions are the complete and exclusive statement of the understandings of the parties
relating to the subject matter of these Terms and Conditions, and supersedes and cancels all previous written
and oral agreements, communications and other understandings. All modifications to this Agreement or any
addendums(s), or exhibits, must be in writing and signed by both parties.
